Just when you thought you have seen it all from our resident jester Paul McCauley, he will prove you wrong.

While reading the informative Sacramento Bee "State Worker" blog, I came across Jon Ortiz' reporting of the latest shot in Mr. McCauley's war on retirees. The Secretary of State has entitled it "Tax on Pension Distributions and Health Care Benefits." It can be found by CLICKING HERE.

In the body of the text is the following statement that California "May impose a one-time, additional tax on non-California residents whose pension benefits exceed $50,000 in a year, and who earned income in California." This sounds very good if it weren't for the fact that it VIOLATES FEDERAL LAW and, in so doing, will necessitate a costly and losing Federal court battle by California to force it on non-resident retirees of California. Why doesn't Paul McCauley, being the Certified Public Accountant that he is, know this?

On January 10, 1996, Legislation restricting the States' right to tax nonresident pension income was signed into law by President Clinton. This was known as the "Pension Source Act" or HR 394, now PL 104-95.

"This law prohibits states from taxing the pensions of non-residents. A retiree can receive pension income, including withdrawals from IRAs and other retirement accounts, without being taxed by their previous state of residence."

As if California doesn't have enough financial problems, now McCauley wants to embroil the State in costly lawsuits to nowhere.

There has been much dissatisfaction throughout the rank-and-file CCPOA membership regarding the disconnect between the Executive Council in Sacramento and the CCPOA foot soldier on the ground. This is largely due to the rank-and-file membership being disenfranchised in the voting process for these positions.

Instead of directly voting for the Executive Council, delegates are sent to the convention to do the voting. Delegates who may or may not know the will of the chapter membership.

In this era of CCPOA, where State Board meetings become a bloodbath of gladiator games in which dissenting Chapter Presidents are put to political death for disagreeing with Mike Jimenez, including Chapter 13s filed against the dissenters by straw men and Chapters being placed under receivership, the rank and file membership needs to directly vote for the Executive Council positions, thereby bypassing the vulnerable Chapter Presidents and delegates which, currently, do the voting.

Merely make enough copies, fill in the information at the top of the form and, after you circulate it within your chapter, present it to your Chapter President.

It may not be well received due to the fallout at State Board these Chapter Presidents are fearful of, however, these petitions will give them the built in defense that the idea didn't come from them, it came from the membership. In this way they can save themselves from the inevitable berating they will face, by Mike Jimenez, at State Board or the fate of Corcoran in which the dissenting chapter was taken over by West Sacramento.

Fundraising For The Church.

After perusing Jon Ortiz' State Worker blog (Click Here), I discovered that robbing the elderly by allowing the reduction of their, current, retirement benefits is not Mr. McCauley's first foray into the body politic.

Paul McCauley, with all the zest of any religious zealot, has several initiatives, one of which, if enacted, will create one of the largest transfers of wealth in California's history, from the California taxpayer, directly to, what is being referred to with increasing frequency as, the "Church of Global Warming". Merely Google "Church of Global Warming" to find out more.

First, as has been previously discussed on this blog, is his plan to open the door for confiscation of the, current, benefits of California's retirees for the purpose of funding benefits for his Global Warming Alarmist parishioners. Now, lets examine his other initiative whose beneficiary will, similarly, be his Parish.

Clearly Mr. McCauley's "Church of Global Warming" has an appetite that is so voracious that it is prepared to consume, in their turn, every catagory of California's citizenship with the confiscation of their assets for purposes that will, not only support and expand the Church doctrine, but may very well get Mr. McCauley a ride on Al Gore's private, fuel guzzling, jet.

The Church of Global Warming seems to be a beneficiary which is common to Mr. McCauley's initiatives, whether it is leaving the elderly destitute or chasing money out of the state, Mr. McCauley is one of the churches most dedicated fundraisers.

The question that each and every California citizen must now ask is, "When will YOU be in Mr. McCauley's cross hairs?"

Paul McCauley's Secret Agenda.

With his pholosophy of, "Whatever it takes to get the job done.", Paul McCauley has, seemingly, revealed his true motivation, for either his incompetence or deception, in attempting to amend the California Constitution through the Initiative process.

Within the last sentence of Mr. McCauley's, ill conceived, proposal is an insight into Mr. McCauley's true agenda. In his final statement, " . . as well as to make an urgent response to global warming effects on the environment.", Mr. McCauley exposes himself as a Deacon in the Church of Global Warming and he wants to sacrifice the elderly and their current pensions on its altar.

My reasoning for this presumption is simple. This stipulation is, completely, out of place when compared with the other purposes which Mr. McCauley has embraced in his initiative. As any purveyor of Sesame Street can attest, the game of "One of these things is not like the other things.", a game which encouraged children to make critical comparisons to determine which, among several items, is out of place, has come into play as Mr. McCauley's "sore thumb".

While Mr. McCauley attempts to take the moral high ground for his robbery of the elderly, his support of global warming issues, and his willingness to put the elderly out in the cold for their support, has been obfuscated but not lost in his rhetoric.

Global Warming (or climate change as it is now being called, due to the confusion among its proponents) is still controversial and there is NO consensus in the scientific community regarding its reality. More controversial still is the notion that climate change is being caused by human activities, and a substantial number of prominent scientists dispute the philosophy that global warming (climate change) is caused by anything other than natural occurrances within our world and our universe.

Mr. McCauley wishes to stir up the fervor of Californians, through deception, regarding economic issues to force the elderly, through reduced pension benefits, to, involuntarily, support his political causes of Global Warming/Climate Change.

Paul McCauley and Sloppy Work.

On Jon Ortiz' State Worker blog, which can be accessed by clicking here, is an email from Mr. McCauley in which he expresses his desire, through his proposed amendment, to modify annuities for retirees that are paid, annually, over $100k:

"As the economy tanks and an increasing number of people lose their jobs, their homes, their 0D 401(k)'s etc., their sympathy for a public employee who believes that he/she has an entitlement to retire on a $100,000 pension will wane."

However, Mr. McCauley has, certainly, NOT done his homework on this figure. As reported by CALPers, in their January, 2009, report, which can be accessed by clicking here, the summary of average annual retiree benefits are as follows:

Average monthly service retirement allowance all retirees: $1,985 X 12 = an annual benefit of $23,820.00

Average monthly service retirement for school miscellaneous members: $1,079 X 12 = an annual benefit of $12,948.00

Average monthly service retirement for State members: $2,291 X 12 = an annual benefit of $27,492.00

Mr. McCauly is, therefore, either (1) misinformed as to these recipients of these monumentally high annuities or (2) he is conducting a campaign of misinformation to further his political agenda. While it is arguable that there may be a few annuitants who draw in excess of $100k as Mr. McCauley asserts, the figures show that they are far from the mainstream CALPers retiree and, in fact, represent a very small fraction of all retirees.

Mr. McCauley's profession is that of a Certified Public Accountant or, in contemporary parlance, a bean counter. His stock and trade is precision in numbers and extracting an accurate bottom line from information that he has determined to be accurate. His foray into the political arena with this, ill conceived, initiative is inconsistent with his training and ethical standards of professional meticulousness. His measure, cited below, is the political equivalent of "fuzzy math" in the accounting world, a concept for which there is no place.

Mr. McCauley states that he is targeting retirees making $100k+ annually, however, this figure is nowhere to be found in his initiative. It, simply, lumps all retirees into the same pen for slaughter, regardless of their annual income.

When measured against his statement of intent, this means either one of two things:

1. Mr. McCauley has, incompetently, formulated an inexact initiative which is not that which he intended.

2. Mr. McCauley is conducting a campaign of misinformation to deceive California, thereby bolstering his own political aspirations.

The disparity between what Mr. McCauley says and what he does is not reconciled in his initiative.

Neither of these scenarios bode well for Mr. McCauley's clientelle, who pay for competence, accuracy and integrity in a CPA. These qualities are a Certified Public Accountant's stock in trade and should be as much a part of Mr. McCauley's political life as it is a part of his professional life and, if lacking in his political life, who is to say that these qualities are present in his professional life?

Perhaps the solution for California's financial ills lies more in the auditing of Mr. McCauley's clientelle by California's taxing agencies to see for themselves if, in fact, any of his political deficiencies have rubbed off into his professional life.

I do not assert that Mr. McCauley may be "cooking the books" for his clientelle, only that elements of his political life may be bleeding into his professional life.

SEC. 9. A bill of attainder, ex post facto law, or law impairing the obligation of contracts may not be passed, *except that public-employee pension contracts may be renegotiated, including reducing vested benefits for existing and prospective retirees, for the limited purposes enumerated hereinafter.*

*1. To enable the state government, local governments and taxing districts to meet the essential public services of fire and police protection, public health, education and prisons.*

*2. To enable California and its political subdivisions to meet long-term public investment needs to provide for fire and police protection, public health, education, prisons, transportation and energy needs as well as to make an urgent response to global warming effects on the environment.*

Paul McCauley and Elder Abuse.

Many years ago, the People of the State of California saw fit to pass laws outlawing Elder Abuse, doing so with good reason.

In a heroic effort to protect some of California's most vulnerable citizens, the California Legislature decided to take action and enact laws to protect our elder residents against abuse by younger and stronger predators. Now, enters Paul McCauley, replete with Gerontophobia, who threatens to, quite literally, take the food out of the mouths and I.V.s out of the arms of the elderly in California, all in a time when these old folks should be enjoying their Golden Years.

Currently, the California Constitution prohibits the abrogation of existing contractual obligations of California. The initiative proposed by Mr. McCauley, and approved for the petitioning process, would add one, narrow exception. All "existing and prospective retirees" who are beneficiaries of "public employee pension contracts" would be subject to have these contracts abrogated through renegotiation, a renegotiation which is prohibited in all other State obligations.

Clearly, the targeting of politically powerless retirees, living on a vastly reduced income, too old to begin another career to make up for the monetary loss that Mr. McCauley proposes, is tantamount to Elder Abuse. Clearly this mean spirited measure will facilitate some secret agenda while robbing the elderly of a decent retirement.

When coupled with current efforts for California to pass an Assisted Suicide bill, Mr McCauley's dark vision, for California's retirees, is clear. In the movie, Soylent Green, the disillusioned elderly, could check into suicide centers called "Home" and self administer a poison to, slowly, die and become one less statistic in an overburdened, surplus population. From there, they were processed into a foodstuff known as Soylent Green for consumption by the existing population.

The fact that Mr. McCauley will feed on the misery of the elderly is obvious since he is expending so much effort to do so, the only remaining question is the form of the feast.

Renegotiation of Public Employee Pension
Contracts. Initiative Constitutional Amendment.

SACRAMENTO: Secretary of State Debra Bowen today announced that the proponent of a new initiative may begin collecting petition signatures for his measure.

The Attorney General prepares the legal title and summary that is required to appear on initiative petitions. When the official language is complete, the Attorney General forwards it to the proponent and to the Secretary of State. The Secretary of State then provides calendar deadlines to the proponent and to county elections officials, and the initiative may be circulated for signatures. The Attorney General’s official title and summary for the measure is as follows:

RENEGOTIATION OF PUBLIC EMPLOYEE PENSION CONTRACTS.
INITIATIVE CONSTITUTIONAL AMENDMENT.

Eliminates certain state constitutional restrictions on renegotiating public employee pension contracts. Allows vested pension benefits to be reduced for existing and prospective public-sector retirees. Summary of estimate by Legislative Analyst and Director of Finance of fiscal impact on state and local government: Possible reduction in pension costs for state and local governments, depending on future actions by state and local governments and courts. Any such reduction likely would be largely or entirely offset by negotiated increases in other costs, such as employee salaries and wages. (08-0018.)

The Secretary of State's tracking number for this measure is 1350 and the Attorney General's tracking number is 08-0018.

The proponent for this measure, Paul McCauley, must collect signatures of 694,354 registered voters – the number equal to 8% of the total votes cast for governor in the 2006 gubernatorial election – in order to qualify it for the ballot. The proponent has 150 days to circulate petitions for this measure, meaning the signatures must be collected by June 22, 2009. The initiative proponent can be reached at pmcca28169@aol.com. A warning to the CCPOA membership.

It is being reported HERE, that there is a letter, appearing to be from Mike Jimenez, circulating throughout the CCPOA membership. This letter is accompanied by a questionnaire which asks the member for personal information of the type that is solicited in, what is referred to, as the Nigerian Lottery Scheme which is perpetrated over the internet. The purpose of such schemes is, ultimately, to gain enough information to commit identity theft.

As reported, there are substantial errors in the information provided in these letters, such as the number of days of the impending furlough (the letter reports only one while everyone else reports two) and the return address which is in Napa (CCPOA has no office in Napa). The letter also refers to the "Executive Board" rather than the "Executive Council".

If you should receive one of these letters, you SHOULD NOT fill out and mail in the attendant questionnaire as requested. It may look official, but many "phishing" scams on the internet direct their victims to fraudulent, yet official looking, web sites. The same can be accomplished through the U.S. Mail.

Instead, you may want to file a report of mail fraud with the Postmaster of your local post office.

A Letter In The E-Mail.

I have, recently, received an e-mail from a thoughtful Correctional Officer who expressed dismay at the cimccpoa website being diverted for purposes other than the posting of information regarding the CIM chapter of CCPOA. I do understand and sympathize with his plight and, under normal circumstances, I would be working closely with the Chapter Board at CIM to continue keeping the blog updated and current. However, things have not gone according to plan as the bungled negotiations of Mike Jimenez have, at all levels, involved the CCPOA membership and their dues money in one, West Sacramento, fiasco after another. Correctional Peace Officers now find themselves working under the implemented terms of the Department of Personnel Administration's Last, Best and Final offer.

CCPOA finds themselves the Defendants in an, ever growing, list of lawsuits filed by Mike's former business associates, and the personal profiting that goes on through the EC member's acquisition of CCPOA assets at fire-sale prices, and the Christmas bonuses for these very same members, makes any continuing support of this system ridiculous. As long as it is "business as usual" every day in CCPOA, things will not need to get better.

For the volunteers that keep CCPOA afloat, perhaps it is time to step back and let CCPOA go. The harder the volunteer works at keeping CCPOA afloat, the more license the EC takes in plundering CCPOA, both philosophically and monetarily. Mike Jimenez has created a feudal system within CCPOA in which there are two classes of membership, the serfs and the royalty even though the price of membership remains the same for both. What would happen if all of the serfs said, "NO MORE".

The deterioration that CCPOA is experiencing, is not unknown nor unpredictable in the corporate world. In many corporations, after the corporate visionary leaves, his/her successors are left with the corporate assets and good name, but not necessarily with the same vision as the founder for the health and unity of the corporation. Rapidly, after the founder exits, pockets of self-serving power develop within the corporation and the unity and health suffer greatly. These are signs that the declination has begun. More volunteerism will not heal this condition, in fact, more volunteerism would be analogous to giving an alcoholic more drinks in the hopes that this would cure him. No, the cure is not to be found in working feverishly to maintain the status quo, the cure lies in excising the cancerous tumor.

Mike's aborted cries of "TOTAL RECALL" at the convention were, immediately, forgotten after the convention's close. It was merely a device to whip up fervor amongst the delegates. It was a bit of parlor magic, some legerdemain to hoodwink, horn-swaggle and bamboozle those in a position to vote for the State President. Perhaps this "TOTAL RECALL" mantra would be better served if it were re-directed against the internal enemies of CCPOA, those who wrap themselves in the banner of the membership and continue to abuse their office.

A recall of any member of the Executive Council can only be accomplished by a State Board Of Directors vote and the State BOD is made up of the Chapter Presidents.

This time it is a good rumor!

RUMOR has it that all of the West Sacramento crowd that is currently suckling from the UPL trough, EC included, will be getting a one way trip back to their institutions from whence they came, courtesy of the DPA express.

Why you ask?

It is rumored that there is the small matter of an unpaid UPL bill for a CCPOA payment to the State of California to the tune of, roughly, $2 Million. This should be GREAT news for all of the West Sacramento bunch. Now they can re-bond with their roots and all of the "little people" who's dues money have made their opulent lifestyle possible.

What an opportunity for the UPL folks to learn and grow from this new experience.

Hopefully, we will be seeing you back at the institutions soon so that you may impart all of the knowledge that you have acquired during your travels. Inquiring minds want to know.

This email by Mike Jimenez, which is an attachment in a lawsuit, gives the reader a unique insight into the aversion of CCPOA towards getting played. CCPOA volunteers, such as job stewards, Chapter Directors and the like, should express the same outrage to getting played that Mike Jimenez expresses in his love life. It seems that the membership of CCPOA has been placed in a box from which there is no escape.

I'll say it again!!

CCPOA is a proud and noble organization!!

I say this twice because there are those that live in the EC box and view any criticism of the CCPOA leadership as union busting. Thereby any argument or evidence in support of one's criticism can be dismissed without discussion. The EC and their minions have made the California Corporation, CCPOA, and the Executive Council inseperable. Any criticism against one of the Executive Council, Mike Jimenez in particular, is portrayed by the EC as being an attack on the corpus of the organization and, if lodged by CCPOA's steering committee - the State Board of Directors, is not tolerated. The offending Chapter President is attacked, berated and belittled, from the podium, at the next State Board.

Constructive and valid Criticism has become the new bogey man that is being blamed for the union's ills instead of blaming the root causation for the criticism. The feeding frenzies on the State Board of Directors, conducted from the podium, have become the new Dog-And-Pony show that deflects attention from the root causes which give rise to the complaints.

Essentially, The Executive Council and their leader have wrapped themselves in the flag of the CCPOA membership and have convinced a sufficient number of members that any criticism of the policies of individual leaders of CCPOA is a direct attack on the organization itself. By cultivating and perpetuating the "seige mentality" within the membership, West Sacramento has silenced it's dues paying opposition. By the elimination of viable, credible candidates for the office of the State President, either immediately before or at the convention itself, Mike Jimenez will always win the election for a lack of a popular selection.

Don't bother to complain about this treatment though, your shouts cannot be heard outside of the box that Mike has placed you in. Just pick up your sword and follow Mike to the next windmill, although you may only get a T-Shirt for your efforts.

The Worth Of Volunteering Job Stewards.

The duties of a Job Steward are analogous to those of a paralegal or legal assistant.

The chart reflects the annual salaries that these occupations command (Find out more by clicking here). This should give the Job Steward volunteer a rough idea of, just how much, he is contributing to the opulent comfort of the EC and the discretionary income of CCPOA. If CCPOA had to pay for the services of the Job Stewards, maybe they would be forced into a positon in which the EC would have to make better financial decisions. The West Sacramento crowd seems to view the CCPOA Job Steward as an expendable asset whose sole purpose in life is to free-up money for the Executive Council so that they and their UPL paid homies can live large on the union dime. As volunteers for CCPOA, you are expected to do your work and keep your mouth shut (remember what the T-Shirt said).

Keep in mind that this figure is representative of only one Job Steward in a union with many more, statewide.

The changing face of unionism is changing the way that CCPOA volunteers need to start thinking. Considering all that the current Executive Council has done to the rank and file membership, perhaps the philosophy of compensated volunteerism has arrived.

"In service to our membership", that's the motto of the CCPOA volunteer. Whether they be a Job Steward, Board Member or serving on one of the numerous CCPOA committees, they make sacrifices in their personal lives to set aside time to be of service to the membership. Unlike the Executive Committee in West Sacramento, these volunteers don't get paid for their efforts even though these unpaid efforts save CCPOA tremendous sums of money because they don't have to hire professionals to do the work that the CCPOA volunteer does, FREE OF CHARGE.

In times past, volunteerism and the money that CCPOA saved in utilizing them was not an issue, why should it be an issue now?

For the first time in CCPOA's history, Board of Director's meetings have become a blood bath for any chapter President who dares to take an alternate viewpoint from Mr. Jimenez. The tactics of Mike Jimenez to get his way at the BOD meetings are intimidating the Chapter Presidents into silence, allowing Mr. Jimenez to get his way on all of HIS issues. It got him reelected didn't it?

CCPOA is spending money like a drunken sailor on projects which are, seemingly, unrelated to "Wages, hours and other terms and conditions of employment", so, clearly, the EC has WAY too much Monopoly money to play with. If they run out, they just have a dues increase. Under this philosophy of opulence in office and virtual unaccountability for dues expenditures, the CCPOA volunteers have every right to demand payment for their personal sacrifices. Sacrifices which free up large sums of money for the EC to lavish upon themselves, friends (UPL) and their self-promoting pet projects.

Gilb Gets It Wrong.

DPA Director Mr. Gilb's letter to Mr Chiang, State Controller, directing him to pay State Employees (CLICK HERE), based upon a formula which does not place State job classifications into any of the three groups Mr. Gilb defines, is cumbersome, nebulous and, if for no other reason than it's incomplete and confused explication, is unenforceable.

I might point out that, even though the California Department of Corrections and Rehabilitation has NOT been exempted from the Governor's Executive Order per Attachment "A", Mr. Gilb has failed to issue any personnel directives to Matthew Cate, CDCR Secretary, directing him to cease and desist ALL OVERTIME for CDCR employees or modifying their job descriptions making them exempt from any "critical nature of the work performed by these departments and programs".

If CDCR employees are still subject to overtime, they are exempt from the minimum wage. This was stated by the California Supreme Court in White v. Davis, a case which Mr. Gilb liberally cites in his opening sentence. Since there has been no directive prohibiting any and all overtime in CDCR, thereby rendering CDCR employees not subject to overtime, the exemption from the imposition of the minimum wage would apply.

Until this is accomplished, Mr. Gilb's letter is incomplete and unenforceable due to the exemption criteria that he establishes in his letter which exempts the agencies listed in Attachment "A", yet omits The California Department of Corrections and Rehabilitation in which, currently, all employees are subject to work overtime.

Either this omission is a mistake or Mr. Gilb has issued a, secret, instruction to Matthew Cate that there will no longer be ANY overtime for employees of the California Department of Corrections and Rehabilitation.

I was pleased to hear that CIM local will have a fine Supervisory leader in Lt. K. Grady "Shady". We have talked in great detail as to what he wants to get done at CIM and I think he will be a great resource for the CIM Chapter.

So please forward all Supervisor concerns to Lt. Grady.

He wants to lead the CCPOA Supervisors in the real union and start getting involved with Supervisory issues at CIM.

There is a issue with the Westyard Hub Sergeant that we will be looking into. It appears that when the job went for bid it was listed as a 8:OO to 4:00 pm position. And because of the hours listed some supervisor's didn't bid on it. And now it appears the hours changed to "vary" hours? (not sure what that means)

Three guards stabbed at Tehachapi prison

3:30 PM PDT, April 3, 2008

California corrections officials say two inmates stabbed three guards at a prison in Tehachapi and all state prisons have been locked down as a precaution.

Department of Corrections spokeswoman Terry Thornton said two sergeants and an officer were stabbed today and were in stable condition at local hospitals.

Thornton says the two inmates are affiliated with Southern California prison gangs.

State prisons will stay locked down until corrections staff can determine that the stabbing was an isolated incident.

Thornton says the inmates rushed the staff in an office on the maximum security general population yard shortly after 1 p.m.

Two weapons were recovered.

In Memory of Our Brother VanDale Kauhane Keliikoa

Correctional Officer VanDale Kauhane Keliikoa passed away March 2nd, 2008.

Officer Keliikoa started in the Department of Corrections March 7, 1988 and began at Corcoran State Prison April 18, 1988 and then transferred to the California Institution for Men in Chino August 14, 1989 where he worked at the West facility until last Friday February 29, 2008.

Officer Keliikoa was to sign out today to be officially retired but passed away yesterday of a Heart attack. Officer Keliikoa "Killer" as we all called him was loved by all who knew and worked with him he will be missed and we all morn along with the family at his passing.

Any funeral arrangements as soon as we are informed will be posted.

Due to the confusion on the patch issue, per the Warden, we have until June 1, 2008 to be in compliance with the November 30, 2006 memo which few have seen. DPA Runs Afoul Of The Law - Again!

To: State Board,

Yesterday we were informed that the PERB (Public Employee Relations Board) has issued a complaint against regarding the Last, Best and Final.

In the complaint, PERB States;

· By implementing terms and conditions for a three-year duration, Respondent acted contrary to the provisions of Government Code sections 3517 and 3517.8 and thus violated Government Code section 3519©.

What this means is that the State has violated Government Code by imposing a Last Best and Final for a period longer than the annual State budget. As a result of this complaint, there will be a settlement conference on January 7, 2008 with a subsequent hearing if settlement is not reached.

At this point, it would appear as though all provisions of the Last Best and Final, including post and bid, are only good until June 30 of 2008.

We will provide more information as it becomes available.

First, it was their defeat by the "Corcoran 8" in an acquittal, then it was their defeat by Correctional Officer Dave Lewis in an acquittal, now it is the reversal of the jury's guilty verdict by the presiding Federal Judge, Manuel L. Real who ruled on Monday, November 26, 2007, that the jurors were wrong when they convicted the "Chino 3", Thomas Ramos, Hector Flores and Robert McGowan.

The reversal of the verdict, dismissed for lack of evidence, is a testimonial that, while U.S. Attorneys and their Deputies continue to wage an increasingly acrimonious war against California Correctional Officers, there are, thankfully, those in the Federal Judicial system which preside over reason and common sense as well as their courtrooms. Clearly, the war waged by Federal Prosecutors against California Correctional Peace Officers is not being joined by the Federal Judiciary.

Animosity is cumulative. With each and every prosecutorial defeat comes a renewed and louder cry of "Hang ‘em High!" The Federal Prosecutors in California have become nothing more than a Haters Club of all things Correctional and, as such, they now join the ranks of such notables as Mike Nifong in his hatred of College Lacrosse players and Johnny Sutton and his hatred of Border Patrol Agents and Texas Sheriffs.

As a suggestion to any Federal Prosecutors who may read this, shed your fixation on California Correctional Personnel and make your reputation elsewhere as it is, obviously, clouding your judgment and your ability to, efficiently, expend taxpayer dollars.

As a result, if you do not make arrangements to mail your fair share payment into CCPOA, the Ralph C. Dills act does not provide for your continuing representation by CCPOA*.

To continue to reap the benefits of your representation with CCPOA without having to write a check each and every month and mail it in, JOIN CCPOA. Only full members are continuing to have their dues deducted and their representation continued, uninterrupted.

For your further review, the following is an excerpt from a letter recently distributed by CCPOA's Benefits and Trust Fund:

"The DPA has informed the CCPOA that it is no longer entitled to receive fair share fee deductions. As a result, people who were Fair Share are no longer members of the CCPOA and therefore, not eligible for any benefits through the CCPOA Benefit Trust Fund. The last Fair Share fee deduction from their payroll warrant occurred in September 2007. As a result those individuals who were Fair Share no longer have benefits through the Trust as of November 1, 2007. The benefits lost are as follows:

CCPOA Primary Dental •
Western Dental•
CCPOA Vision Service Program (VSP)•
$20,000 Basic Life Insurance •
$5,000 Accidental Death •
Basic Legal Defense Fund•
Basic Family Legal Plan offered through Caldwell Legal•

This action was taken by DPA. There is nothing that the CCPOA or CCPOA Benefit Trust Fund can do about what has happened. If a former Fair Share member has any questions, please direct him/her to contact William Page, Program Manager, Department of Personnel Administration at 916-445-9801."

Our-Man-In-Sacramento, Marty Aroian, has agreed to be at the CIM Chapter meeting on Monday, November 19, 2007 at 1630, at Mr. Berry’s BBQ. For directions, please consult the link at the left entitled "Chapter Meeting Schedule".

We appreciate Marty taking time out of his busy schedule to explain the current state of the BU6 MOU negotiations and a view down-the-road. Since he is on the Contract Negotiating Team, he will have up-to-the-minute information for all of us.

Regarding the Checks . . .

In a meeting on October 11 2007 between CIM Management , CIM Personnel and CCPOA ....CCPOA was told by the beginning of the year new policies were to be started, checks were only to be issued on the 15th and payday only .... there would be some exceptions such as days off and Vacations but Management and Personnel feel they don't have a responsibility to leave pay checks in areas where they are not secured or signed for or opened by anyone other than who the check is issued by...

CCPOA stated Bu6 members have a right to have their checks available to them after they have earn them ... Personnel also stated they were going to have checks in a central location on paydays instead of at the facilities ...they suggested MSF visiting , CCPOA again protested that the BU 6 members have a right to receive their checks in a timely manor during working hours ...Personnel staff seemed to be willing to accept the idea of Personnel staff going to each facility to issue checks .... CCPOA stated we felt that impeding staff from getting their checks in a timely manor such as having to go to a central area to stand in line after their shift was unreasonable they stated before they changed policy they would meet with us again .... CCPOA told personnel and Management that Debra Turner brought this idea to Gary Clark when he was chapter president in 2000 , we agreed with the idea do personnel staff coming to each facility to issue checks, this idea was shot down by then Warden Lori Decarlo.
